Terms of Use

These terms are an agreement between you and Velyus Inc. (“we”, “us”) about your use of the Urge Buddy app and website. By using Urge Buddy, you agree to them. If you don’t agree, please don’t use the app.

1. Who can use Urge Buddy

You must be at least 13 years old. If you’re under the age of majority where you live, you need a parent or guardian’s permission, and they agree to these terms on your behalf.

2. What Urge Buddy does

When an urge hits, you tap your buddy in the app and get a short task, from one to five minutes, to do until it passes. The app also offers a short check-in with your buddy each morning and night, and can use Apple’s Screen Time features to lock apps you choose until you’ve checked in.

App locking depends on Apple’s Screen Time system and your device settings. We can’t guarantee that every app will always be locked or unlocked exactly on time, and you can turn off Screen Time access in your device settings at any time.

3. Subscriptions

• Urge Buddy requires a paid subscription. Prices are shown in the app before you buy.
• Some subscriptions start with a free trial. Unless you cancel at least 24 hours before the trial ends, your subscription begins and you’re charged automatically.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the renewal date. Your Apple account is charged within 24 hours before renewal.
• You can manage or cancel your subscription in your Apple ID settings (Settings → your name → Subscriptions). Deleting the app doesn’t cancel it.
• Payments are processed by Apple. Refunds are handled by Apple under its policies.

4. Not medical care

Urge Buddy is a habit and wellbeing tool. It isn’t therapy, medical care, addiction treatment or a crisis service, and your buddy’s replies, including those written by AI, aren’t professional advice. Stopping some substances, such as alcohol, suddenly can be dangerous; talk to a doctor before you do. Only do the tasks that are safe for you, and skip any that aren’t. If you’re struggling or in danger, please contact your local emergency number or a crisis line in your area.

5. What you write

What you write to your buddy is yours, and it’s never shown to anyone else. When AI replies are on, your messages are processed as described in our Privacy Policy. Please don’t use the chat to try to make the AI produce harmful, illegal or abusive content.

6. Our app and brand

The app, its design, the Urge Buddy name and logo, the buddy character and everything we create are owned by Velyus Inc. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, as allowed by Apple’s Usage Rules. Don’t copy, modify, reverse engineer or resell the app, or try to interfere with how it works.

7. Disclaimers

Urge Buddy is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise the app will always be available, uninterrupted or error-free, or that it will help you break a habit.

8. Limitation of liability

To the fullest extent the law allows, Velyus Inc. won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or opportunities, arising from your use of Urge Buddy. Our total liability for any claim relating to the app is limited to the amount you paid us for Urge Buddy in the 12 months before the claim. Some places don’t allow these limits, so they may not fully apply to you.

9. Ending your use

You can stop using Urge Buddy at any time by deleting the app and cancelling your subscription. We may suspend or end your access if you break these terms. Sections 6, 7, 8 and 11 continue to apply after that.

10. Apple

These terms are between you and Velyus Inc., not Apple. Apple isn’t responsible for Urge Buddy or its content, has no obligation to provide maintenance or support for it, and isn’t responsible for any claims relating to it, including product liability claims, claims that the app doesn’t meet legal or regulatory requirements, consumer protection claims, or intellectual property claims. If the app fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you aren’t located in a country subject to a U.S. Government embargo or listed on a U.S. Government list of prohibited or restricted parties. Where these terms are silent, Apple’s Standard Licensed Application End User License Agreement applies.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario, unless the consumer protection laws where you live give you the right to bring it elsewhere.

12. Changes

We may update these terms. If we make significant changes, we’ll update the date at the top and let you know in the app. Continuing to use Urge Buddy after that means you accept the updated terms.
